Terms of Use

By downloading or using Clucky ("the app"), you agree to these terms and to Apple's Licensed Application End User License Agreement, which applies where these terms are silent.

1. What Clucky is

Clucky is an alarm clock app with wake-up missions. It is provided by Adrian Angelo Abelarde ("we", "us").

2. The important one: do not rely on Clucky alone

Alarms can fail. iOS may terminate background apps, Focus modes, volume settings, Low Power Mode, device crashes, or OS bugs can prevent an alarm from sounding. Do not rely solely on Clucky for waking up when missing an alarm could cause harm or loss (flights, exams, medication, work shifts, or anything safety-critical). Use a backup alarm. To the maximum extent permitted by law, we are not liable for damages arising from a missed or late alarm.

3. Subscriptions

• Clucky Pro is an auto-renewable subscription billed to your Apple account. Current options and prices are shown in the app before you subscribe.
• Free trials, where offered, convert automatically to a paid subscription unless cancelled at least 24 hours before the trial ends.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel in your App Store account settings; deleting the app does not cancel a subscription.
• Billing, refunds, and cancellation are handled by Apple under their terms.

4. Acceptable use

Use the app only as intended and in compliance with law. Do not attempt to reverse engineer, resell, or interfere with the app or its services.

5. Intellectual property

The app, including the rooster, artwork, sounds, and code, is our property or licensed to us. Your license is personal, non-exclusive, and non-transferable, per Apple's standard EULA.

6. Warranty disclaimer

The app is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation.

7. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the app is limited to the amount you paid for the app in the twelve months before the claim.

8. Changes and termination

We may update the app, these terms, or discontinue features. Continued use after changes means acceptance. We may suspend access for abuse.

9. Governing law

These terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law rules.
